1. Overview
PRG Lead Vault is a data processing platform that provides phone number scrubbing services to help real estate professionals identify phone numbers listed on the National Do Not Call (DNC) Registry and other DNC databases. This policy describes your obligations as a user of our platform with respect to the Telephone Consumer Protection Act (TCPA) and related regulations.
By using PRG Lead Vault's scrubbing or export features, you confirm that you have read, understood, and agree to comply with this Compliance Policy.
2. Laws You Must Comply With
As a user of PRG Lead Vault, you are responsible for complying with all applicable federal and state laws governing telephone communications and telemarketing, including but not limited to:
- Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227: Restricts telephone solicitations and the use of automated telephone equipment. Requires prior express written consent for autodialed or prerecorded calls/texts to cell phones.
- FCC Regulations (47 CFR Part 64): Federal rules implementing the TCPA, including calling time restrictions (8 AM–9 PM local time), identification requirements, and opt-out mechanisms.
- National Do Not Call Registry (16 CFR Part 310): Federal registry maintained by the FTC. Telemarketers are generally prohibited from calling registered numbers. Sellers must access and honor the registry.
- State Do Not Call Laws: Many states maintain their own DNC registries and telemarketing regulations that may be stricter than federal law. You are responsible for compliance in every state where you contact leads.
- CAN-SPAM Act (15 U.S.C. § 7701 et seq.): If you use contact data to send commercial emails, you must comply with this law's requirements including opt-out mechanisms and accurate sender information.
- Real Estate Licensing Laws: Applicable state laws governing real estate solicitations and transactions.
3. Your Obligations Before Contacting Leads
Before contacting any individual whose information has been processed through PRG Lead Vault, you must:
- Confirm consent or lawful basis: Verify that you have obtained proper consent from the individual or that you have a recognized lawful basis to contact them (e.g., established business relationship, prior consent on record).
- Check the National DNC Registry: Maintain a current subscription to the National DNC Registry and check all numbers before calling. Subscriptions must be renewed regularly.
- Check state DNC registries: For each state where you intend to contact leads, verify compliance with that state's DNC registry and telemarketing laws.
- Honor opt-outs immediately: If any individual asks to be removed from your contact list, you must honor that request immediately and add the number to your internal DNC list.
- Maintain an internal DNC list: Keep and regularly update your own internal Do Not Call list. PRG Lead Vault's DNC flags assist with this but do not substitute for your own list management obligations.
- Respect calling time restrictions: Never call before 8:00 AM or after 9:00 PM in the called party's local time zone.
- Identify yourself: Always identify yourself and the company on whose behalf you are calling at the beginning of the call.
4. What PRG Lead Vault Provides — and Does Not Guarantee
PRG Lead Vault's scrubbing service checks phone numbers against third-party DNC databases (including via the BatchData API). However:
- DNC registry data is updated periodically and may not reflect the most recent registrations.
- Our scrub results are sourced from third-party APIs and may not be 100% complete, accurate, or current.
- A "clean" result from our scrub does not guarantee that a number is legally safe to call — it means the number was not found in the databases we checked at the time of the scrub.
- We do not check every state-level DNC registry. Our service focuses on federal DNC and select databases.
- PRG Lead Vault does not guarantee TCPA compliance or DNC compliance for any individual or set of phone numbers.
5. Prohibited Uses
You are expressly prohibited from using PRG Lead Vault to facilitate any of the following:
- Sending unsolicited commercial messages (spam) via phone, text, or email.
- Making autodialed or prerecorded calls to cell phones without prior express written consent.
- Calling or texting numbers on the National DNC Registry without a recognized exemption (e.g., established business relationship).
- Contacting individuals who have previously opted out of your communications.
- Making calls for the purpose of harassment, threats, or intimidation.
- Using contact data obtained through this platform for any purpose other than lawful real estate business communications.
- Selling or transferring processed lead data to third parties for use in telemarketing or solicitation campaigns.
6. Your Liability — PRG Lead Vault Is Not Responsible
You acknowledge and agree that:
- PRG Lead Vault is a tool, not a compliance guarantee. We provide software to assist your workflow; we are not your legal counsel, compliance officer, or guarantor.
- You are solely responsible for all calls, texts, and communications you make using data processed through this platform.
- Any TCPA violation, FCC enforcement action, private lawsuit, fine, penalty, or other legal liability arising from your use of processed data is entirely your responsibility.
- PRG Lead Vault and its owners, employees, and agents are not liable for any regulatory fines, lawsuits, settlements, or other consequences of your non-compliance with TCPA, DNC laws, or any other regulation.
TCPA violations can result in statutory damages of $500–$1,500 per violation, and violations are enforced by the FTC, FCC, state attorneys general, and private plaintiffs. Take compliance seriously.
7. Compliance Records
PRG Lead Vault records a timestamp and confirmation each time you accept a TCPA/DNC compliance checkbox within the platform. These records are maintained for audit purposes and may be used to document your acknowledgment of compliance obligations. By clicking compliance checkboxes, you are creating a verifiable record of your commitment to compliance.
8. Reporting Violations
If you suspect that another user of this platform is misusing the Service in violation of TCPA or DNC regulations, please report it through our Support section. We take misuse seriously and will take appropriate action, including account termination.
